# Polyethylene (LDPE, LLDPE): Regulation

Recycled-content rules in Europe and India

Source page: https://www.materialinsights.org/chemicals/polyethylene/regulation/

What this tab covers How it is regulated and what could disrupt supply: hazard classification, rules in the EU, US and India, anti-dumping duties and other trade measures, and supply-risk notes.

#### Hazards

| Classification | UN number | Key risks |
|---|---|---|
| not classified as hazardous | none | Combustible; fine powder can form explosive dust clouds in silos. Environmental risk from pellet spills and from leaked film waste. |

#### Main rules

| Where | Rule | Effect |
|---|---|---|
| **EU** | Packaging and Packaging Waste Regulation (EU) 2025/40 | Recycled-content targets for plastic packaging from 2030 (35% for most non-contact-sensitive packaging, 10% for contact-sensitive non-PET packaging) and recyclability-by-design rules (indicative). |
| **EU** | Plastic packaging own resource (EU budget levy) | Member states pay €0.80 per kg of non-recycled plastic packaging waste since 2021 (indicative). |
| **UK** | Plastic Packaging Tax | Tax per tonne on packaging with under 30% recycled content (indicative). |
| **US** | State packaging EPR laws (e.g. California SB 54) | Producer fees and recycling targets for packaging (indicative). |
| **Global** | UN plastics treaty negotiations (INC) | No agreed treaty text as of 2025 (indicative); production caps remain contested. |

#### India

| Rule | Effect |
|---|---|
| **Plastic Waste Management Rules 2016, EPR Guidelines 2022 and PWM (Amendment) Rules 2026** | Recycled-content and recycling targets on producers, importers and brand owners; tradable EPR certificates on the CPCB portal; FY2025-26 shortfalls may be carried forward three years. |
| **Single-use plastics ban (1 July 2022)** | Bans identified items such as plastic cutlery, plates, cups, straws, ear-bud sticks and polystyrene (thermocol) decoration; carry bags thinner than 120 microns banned from Dec 2022 (indicative, MoEFCC notification 2021). |
| **BIS Quality Control Order on polyethylene (Jan 2024, rescinded Nov 2025)** | Restricted imports from non-BIS-certified plants while in force (CareEdge 2025). |

#### Trade measures

- US tariffs of 19-20% on goods from Malaysia, Thailand, Philippines, Indonesia and Vietnam (Argus, Feb 2026) redirect Asian converters' PE demand
- EU 6.5% duty on US resin under consideration for removal (Argus, Sep 2025)
- No current Indian anti-dumping duty on LDPE or LLDPE confirmed in sources reviewed
- 2026 Hormuz disruption acted as a de facto supply cut from the Gulf

#### Supply risk

Global supply is diversified, but India depends on Gulf PE shipped through Hormuz. Polyethylene is not on critical-materials lists; the policy risk runs the other way, through bans, levies and recycled-content mandates.
