# Polystyrene and EPS: Regulation

Bans on foam food boxes and Indian thermocol rules

Source page: https://www.materialinsights.org/chemicals/polystyrene/regulation/

What this tab covers How it is regulated and what could disrupt supply: hazard classification, rules in the EU, US and India, anti-dumping duties and other trade measures, and supply-risk notes.

#### Hazards

| Classification | UN number | Key risks |
|---|---|---|
| PS not classified; EPS beads release flammable pentane; residual styrene (IARC Group 2A, probably carcinogenic, 2018) is limited in resin (indicative) | UN2211 (EPS beads); none for GPPS/HIPS | Pentane fires in EPS storage; styrene monomer storage hazards, as at Visakhapatnam in 2020; burning PS gives dense smoke. |

#### Main rules

| Where | Rule | Effect |
|---|---|---|
| **EU** | Single-Use Plastics Directive (2019/904) | Bans EPS food containers, beverage containers and cups from July 2021 (indicative). |
| **Global** | Stockholm Convention listing of HBCD (2013) | Forced EPS makers to switch to polymeric flame retardants (indicative). |
| **US** | State and city bans on EPS foodware (e.g. Maine, Maryland, New York) (indicative) | Shrinks food-service foam demand. |
| **EU** | Packaging and Packaging Waste Regulation (EU) 2025/40 | Recyclability-by-design rules that PS packaging will struggle to meet without collection systems (indicative). |

#### India

| Rule | Effect |
|---|---|
| **Plastic Waste Management Rules 2016, EPR Guidelines 2022 and PWM (Amendment) Rules 2026** | Recycled-content and recycling targets on producers, importers and brand owners; tradable EPR certificates on the CPCB portal; FY2025-26 shortfalls may be carried forward three years. |
| **Single-use plastics ban (1 July 2022)** | Bans identified items such as plastic cutlery, plates, cups, straws, ear-bud sticks and polystyrene (thermocol) decoration; carry bags thinner than 120 microns banned from Dec 2022 (indicative, MoEFCC notification 2021). |
| **MSIHC Rules 1989 and post-2020 safety reviews for styrene storage** | Styrene is a listed hazardous chemical; storage at PS plants needs safety reports and emergency plans (indicative). |

#### Trade measures

- China's anti-dumping duties on styrene from the US, South Korea and Taiwan (from 2018, styrene tile)
- No current Indian trade remedy on PS or EPS confirmed in sources reviewed

#### Supply risk

India is fully dependent on imported styrene, much of it from the Gulf through Hormuz. PS is not on critical lists; regulatory demand risk is high.
