Small-molecule APIs: Regulation

Why one inspection letter can shut a supplier out

What this tab covers How it is regulated and what could disrupt supply: hazard classification, rules in the EU, US and India, anti-dumping duties and other trade measures, and supply-risk notes.

Hazards

ClassificationUN numberKey risks
varies by molecule; many are reproductive toxicants, sensitisers or STOTvaries (UN2811, UN3077 or not regulated)Worker exposure to potent compounds, solvent fires and runaway reactions, and contamination (e.g. NDMA impurities in sartans, 2018).

Main rules

WhereRuleEffect
USFDA CGMP and ICH Q7; DMF system; BIOSECURE Act (FY2026 NDAA, Dec 2025)inspections gate market access; BIOSECURE bars federal contracts tied to listed Chinese biotech firms
EUEU GMP Part II; written confirmation for API imports (Falsified Medicines Directive); CEP; Urban Wastewater Treatment Directive (2024) extended producer responsibilitypharma and cosmetics firms to fund at least 80% of extra wastewater treatment cost
ChinaEnvironmental inspections and park consolidationperiodic capacity closures

India

RuleEffect
Drugs and Cosmetics Act 1940; revised Schedule M GMP (notified Dec 2023; MSME deadline Dec 2025)raises GMP bar for small API makers
PLI scheme for bulk drugs (Rs 6,940 crore, 2020): 41 products, incentives up to 20% of sales for fermentation productssubsidises greenfield KSM and API plants
Minimum import price on penicillin G, 6-APA and amoxicillin (DGFT, Jan 2026)floor on Chinese import prices for one year
EIA Notification 2006; bulk drug projects moved from Category A to B2 in 2020faster environmental clearance; zero liquid discharge required in many clusters

Trade measures

  • India MIP on three antibiotic inputs (2026)
  • DGTR anti-dumping probes on penicillin G, 6-APA, amoxicillin and montelukast from China (Sept 2026)
  • US Section 232 investigation on pharmaceuticals and APIs (2025)

Supply risk

High concentration in China for KSMs and fermentation intermediates. India's Department of Pharmaceuticals identified 53 critical APIs where import dependence was highest, which shaped the PLI list. Many generic APIs have only two or three qualified suppliers.
